As an employee, it's crucial to be aware of your rights when disclosing sick leave information. Your right to privacy in the workplace extends to all aspects of your employment, including taking time off for medical reasons.
You have the right to maintain the confidentiality of your personal and medical information. This means you are not obligated to share specifics about your condition with your employer, such as diagnoses, symptoms, treatments, medications, or any other personal medical details. Also, your employer is prohibited from accessing your medical records without your written consent. If they obtain this information, they must handle it confidentially and only utilise it for legitimate, employment-related purposes.
It's essential to note that in South Africa, the Protection of Personal Information Act (POPIA) safeguards individuals' personal information, including medical data. You may have legal options if your employer breaches this act by disclosing your medical information without consent.
